Protective Services

The county department of job and family services has the duty to investigate reports of abuse, neglect or exploitation of adults over the age of 60
(R.C. 5109.62). If the county department of job and family services determines that an adult over the age of 60 is incapacitated and in need of protective services, that agency may petition the probate court for an order authorizing the provision of protective services to that person. The petition must include a proposed protective services plan (R.C. 5101.65).

If the court finds by clear and convincing evidence that the person over 60 years of age is incapacitated, has been abused, neglected or exploited and is in need of protective services, the court shall issue an order requiring the provision of protective services (R.C. 5101.67). An order for the provision of protective services shall remain in effect for no longer than six months, but the court may grant renewals of the order for no longer than one year each (R.C. 5101.67(E)).
